Check a Brazilian termination line by line: proportional notice, 13th salary, holiday pay, the FGTS penalty and what is withheld.
A termination package is not one number, it is a list. The company owes the days worked in the final month — the salary balance — and then, depending on how the contract ended, the notice period, a proportional 13th salary, proportional holiday pay with its constitutional third, any holiday period you earned and never took, and a penalty on the FGTS. Each line is calculated and rounded to the cent on its own, which is why a TRCT total never matches one tidy multiplication. Two lines carry deductions and the others do not: INSS and income tax fall on the salary balance and, in a separate incidence, on the 13th salary, while an indemnified notice and every form of indemnified holiday pay are exempt from both.
Two rules settle most disagreements. The notice period stopped being a flat 30 days in 2011: Lei nº 12.506 adds three days for each completed year with the same employer, up to 90. Ten years of service is 60 days, twenty is 90, and a calculator still paying 30 is short by a month of salary or more. An indemnified notice also counts as time of service: the contract is treated as ending on the projected date, and that projection feeds the 13th salary and the holiday twelfths. The second rule is the fifteen-day one: a month with fifteen days of work or more counts as a whole twelfth, and fourteen counts as nothing. One day decides a twelfth of the 13th salary and a twelfth of the holiday pay.
What separates the four endings is the list, not the arithmetic. Dismissed without just cause, everything above is due, the FGTS carries a 40% penalty and the whole account is released. Resign and the proportional 13th and holiday still come to you, but there is no penalty, no withdrawal and no unemployment insurance — and if you gave no notice the company may deduct 30 days, never the proportional ones, because that proportionality is your right, not your obligation. The art. 484-A agreement halves an indemnified notice, cuts the penalty to 20% and releases 80%. Just cause leaves the salary balance and untaken holiday. What no calculator can price is what your records are missing — unpaid overtime, collective-agreement clauses, averages — so those are listed under the result, unpriced and on purpose.
Salary balance = monthly salary ÷ 30 × days worked in the final month. Notice period = 30 days + 3 per completed year of service, capped at 90 and halved when a mutual agreement indemnifies it, valued at salary ÷ 30 × days. Proportional 13th salary = salary ÷ 12 × twelfths of the civil year, a month counting as a twelfth from 15 days of work. Proportional holiday = salary ÷ 12 × twelfths since the last anniversary of the contract, plus one third. Holiday never taken = one salary plus one third per period. INSS = bracket rate × base − amount to deduct, applied separately to the salary balance and to the 13th salary; income tax = max(0, bracket rate × base − amount to deduct − exemption reducer) on those same two bases, while the indemnified notice and indemnified holiday are exempt from both. FGTS penalty = 40%, or 20% by mutual agreement, of the deposits of the contract including the 8% due on the salary balance, the 13th and the indemnified notice. Every amount is held in whole cents and rounded half up, once per line.
